Terms of Service

These terms govern your use of MKTG ("the platform"). By creating an account you agree to them. If you do not agree, do not use the platform.

1. Your account

You must give accurate details and keep your password secure. You are responsible for everything done through your account. Accounts are for a single business owner or team; you may not resell access.

2. Credits, plans and payment

Some features consume credits. Credits are granted with your plan, or bought separately. Payments are handled by Stripe; we never store your card details. Subscriptions renew automatically until cancelled, and you can cancel at any time from your billing portal. Cancelling stops future charges but does not refund the current period.

Credits are a licence to use platform features. They have no cash value, are not transferable, and unused purchased credits expire 24 months after purchase.

3. Refunds

Credits are not refundable. Once credits are used to generate content, they are spent, whether or not you choose to use the result. If a generation cannot be completed, the platform retries it automatically at no extra cost. Nothing in these terms affects your statutory rights under UK consumer law. For subscription refund requests, contact us within 14 days of the charge.

4. AI-generated output

Output is a starting point, not professional advice. The platform uses AI models to draft copy, briefs and images. Output can be inaccurate, biased or unintentionally similar to existing material. You must review, fact-check and approve everything before you publish it. You are solely responsible for what you publish, including advertising, financial, medical and legal compliance in your market.

Subject to your payment of applicable fees, you own the outputs you generate, to the extent ownership is available in law. We may generate similar output for other users.

5. Acceptable use

You may not use the platform to create unlawful, deceptive, hateful, harassing, sexually explicit or infringing material, to impersonate a person or brand you do not represent, to attempt to bypass credit limits or security controls, or to scrape or reverse engineer the service.

6. Material you upload

You keep ownership of logos, images and text you upload. You confirm you have the rights to use them, and you grant us a limited licence to process them purely to deliver the service to you.

7. Availability

We aim for high availability but the service is provided "as is" without uptime guarantees. Features may change or be withdrawn. We depend on third-party providers, and their outages can affect us.

8. Liability

Nothing here limits liability for death, personal injury, or fraud. Otherwise, and to the extent the law allows, our total liability to you is capped at the amount you paid us in the 12 months before the claim, and we are not liable for lost profits, lost business or indirect losses.

9. Suspension and termination

We may suspend or close accounts that breach these terms or create legal risk. You may close your account at any time from Settings.

10. Changes and governing law

We may update these terms, and we will show the new date above. Continued use means acceptance. These terms are governed by the laws of England and Wales, with the exclusive jurisdiction of the courts of England and Wales.
